1. general provisions / validity

1.1 Services and deliveries of Garten-Q GmbH are based on these General Terms and Conditions. Verbal collateral agreements do not exist.

1.2 These GTC apply to all contracts and orders between Garten-Q GmbH and the customer. Customers can be consumers as well as entrepreneurs or legal entities under public law. For customer, the term client can also be used in the further course of the GTC.

1.2.1 Any natural person who concludes a legal transaction for a purpose that cannot be attributed to his commercial or independent professional activity shall be considered a consumer.

1.2.2 An entrepreneur within the meaning of these GTC is any natural person or legal entity or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the legal transaction.

1.3 The reference to the customer's terms and conditions of business in the form is objected to.

2. conclusion of the contract / language of the contract

2.1 The products and/or services listed within the online presence of Garten-Q GmbH do not constitute binding offers Garten-Q GmbH ; rather, it is an invitation to the customer to submit a binding offer by placing an order or placing an order.

2.2 The Customer (consumer or entrepreneur) has the possibility to order the production and delivery of the desired goods by fax, letter or e-mail.

2.3 By sending the order, the customer places a binding order for the items contained in the order. The receipt of the order will be confirmed to the customer by Garten-Q GmbH in text form (e.g. by e-mail).

2.4 A purchase contract is concluded with the acceptance of the order by Garten-Q GmbH (e.g. by sending an e-mail including order confirmation and / or invoice). In this respect, Garten-Q GmbH is entitled to accept the customer's contractual offer within 14 calendar days of receipt of the order. No purchase contract is concluded for products that are not listed in the e-mail or invoice. If Garten-Q GmbH has not accepted the customer's offer within 14 days, the offer is considered rejected. If the customer does not have a deliverable e-mail address, the order confirmation will be sent by letter or fax.

2.5 The contractual language is German.

3. prices; terms of payment

3.1 Indicated prices refer to Germany, unless otherwise expressly described. Other prices and delivery costs may apply abroad. Customs duties and value added tax may have to be added by the customer.

3.2 The customer may only offset counterclaims if the counterclaim is undisputed or has been legally established.

3.3 Online payment

In our online stores (http://garten-q.de or Google shopping) the following payment methods are available:

Prepayment

If you choose payment in advance, we will give you our bank details in a separate email with invoice attachment. According to the stated delivery time and agreement with you, we deliver the goods after receipt of payment.

PayPal

If you choose the payment method PayPal, you will either receive an additional mail with an invoice attachment and a payment request via PayPal or you will be redirected to the website of the online provider PayPal during the order process.

In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. We request PayPal to initiate the payment transaction. You may receive further instructions during the ordering process. The payment transaction is carried out by PayPal immediately after your payment instruction.

The payment with PayPal is associated with additional costs for you in the amount of 1% of the other invoice amount. We bear any additional costs of this method of payment. According to the stated delivery time and agreement with you, we deliver the goods after receipt of payment.

4. delivery and shipping conditions; transfer of risk

4.1. Garten-Q GmbH will deliver the purchased items - unless otherwise agreed with the customer - by shipping to the address specified by the customer.

4.2 Self-collection by the customer is possible, but must be agreed separately in advance.

4.3 Information on the expected delivery period shall not be binding unless we expressly guarantee a delivery date in individual cases.

4.4 Partial deliveries are permissible insofar as they are reasonable for the customer.

4.5 The Garten-Q GmbH points out that the risk of accidental loss and accidental deterioration of the sold goods for entrepreneurs with the handover of the goods to themselves or a person authorized to receive, in the case of mail order purchase, however, with the delivery of the goods to a suitable transport person.

4.6 In the case of consumers, the risk of accidental loss and accidental deterioration of the sold goods shall always pass to the consumer only upon handover of the goods to the consumer; thus also in the case of a mail order purchase.

4.7 The risk of accidental loss and accidental deterioration of the sold goods shall also pass to the customer if the customer is in default of acceptance.

4.8 We reserve the right to withdraw from the contract if we are not able to deliver the ordered goods (e.g. if a supplier does not fulfill his contractual obligations). In such a case, we will inform the customer immediately about the non-delivery of the goods and refund already made payments to the customer without delay.

5. transport damages / preclusion period for notification of defects

The customer shall inspect the goods upon delivery still during the presence of the delivery forwarder. If goods are delivered with obvious damage to the packaging, the customer must refuse acceptance. Otherwise, the customer is liable for such damage himself, provided that the forwarding agent refuses to settle the damage with reference to a proper delivery.

If there is only slight damage to the packaging on delivery, the goods can be accepted. In this case, however, the damage must be clearly described on the receipt and the same must be kept. In this case, pictures of the damage must be taken immediately and the goods must be inspected (if possible, in the presence of the forwarding agent).

If no transport damage is visible from the outside, the customer must nevertheless inspect the goods for defects in a timely manner. The customer must notify Garten-Q GmbH of any defects, without prejudice to his warranty rights, no later than two weeks after receipt of the goods.

If the customer acts as an entrepreneur, § 377 HGB (German Commercial Code) shall apply with regard to the standard of review.

6. cancellation policy for distance contracts

6.1 Right of withdrawal: The consumer may withdraw from the contract within two weeks without giving reasons in writing (eg letter, fax, e-mail) or by returning the goods. The period begins after receipt of this instruction in text form. Furthermore, the period does not begin before the fulfillment of our duty to inform according to § 312c Abs. 2 BGB i.V.m. § 1 Abs. 1, 2 and 4 BGB-InfoV as well as the obligations according to § 312e Abs. 1 Satz 1 BGB in conjunction with. § 3 BGB-InfoV. The timely dispatch of the revocation or the item shall be sufficient to comply with the revocation period.

Please note point 6.5. as there is no right of withdrawal for individually manufactured products!

6.2 Consequences of revocation: In the event of an effective revocation, the services received by both parties shall be returned and any benefits derived (e.g. interest) shall be surrendered. If the consumer cannot return the received delivery or service in whole or in part, or can only return it in a deteriorated condition, compensation must be paid to this extent. This does not apply if the deterioration of goods was caused exclusively by inspection of the goods. In addition, the consumer can avoid the obligation to pay compensation for a deterioration caused by the intended use of the goods by not using the goods as if they were his property and refraining from doing anything that would reduce their value. Goods that can be sent by parcel are to be returned. Goods that cannot be sent by parcel post will be collected from the consumer. The consumer shall bear the costs of the return shipment, provided that the delivered goods correspond to the ordered goods, only if the purchase price of this item does not exceed the amount of € 40.00 or if, in the case of a higher price of this item, the consideration or a contractually agreed partial payment has not yet been made at the time of the revocation. Otherwise, the return is free of charge for the consumer. Obligations to refund payments must be fulfilled within 30 days. The period begins for the consumer with the dispatch of the consumer's notice of revocation or the item, for us with its receipt.

6.3 If a purchased item was collected by the customer, the customer is responsible for returning the item to the place of collection.

6.4 Special notes: In the case of a service, the consumer's right of withdrawal shall expire prematurely if the contractual partner has commenced the performance of the service with the consumer's consent before the end of the withdrawal period or if the consumer has initiated this. If the consumer has commissioned the assembly and/or installation of the goods, the right of withdrawal with regard to this service and the associated goods shall expire prematurely if the execution of this service (assembly/installation) has begun with the consumer's consent before the end of the withdrawal period. Costs for the disassembly/dismantling of the goods shall also be borne by the customer if this is to be carried out by the Garten-Q GmbH or third parties.

6.5 No right of withdrawal shall apply to custom-made products or products to be manufactured individually according to the customer's specifications. Custom-made products also include individually manufactured Garten[Q], which are produced in a specific color combination and/or stripe design and/or roof shape (e.g. with roof greening module) according to the consumer's wishes. In this case, the materials are ordered explicitly for the customer (e.g. color/roof components) and processed according to his wishes (e.g. stripe design doors and roof).

7. retention of title

Until full payment by the customer, Garten-Q GmbH retains ownership of the goods.

8. rights in case of defects of the item (warranty)

8.1 In the event of defects, the statutory warranty provisions shall apply.

8.2 Damage caused by improper or non-contractual measures taken by the customer during installation, use, connection, operation or storage shall not give rise to any claims against us.

9 Limitation of liability

9.1 The Contractor shall only be liable for damages other than those resulting from injury to life, body and health insofar as these damages are based on intentional or grossly negligent actions or on culpable violation of an essential contractual obligation by the Contractor or its vicarious agents. An essential contractual obligation is an obligation the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the Buyer may regularly rely. Any further liability for damages shall be excluded. Claims arising from a guarantee given by Contractor for the quality of the object of purchase and the Product Liability Act shall remain unaffected by this.

10 Data protection

In all data processing operations (e.g. collection, processing and transmission), we proceed in accordance with the statutory provisions. The buyer agrees that the personal data and orders transmitted by him are stored electronically by us. We are entitled to pass on the data required for the execution of the contract also to third parties engaged for the execution of the contract.

11. reference advertising

11.1 The purchaser agrees that Garten-Q GmbH may use the name, location and, if applicable, the logo of the purchaser on the websites of Garten-Q GmbH and its social media presences without any time or place restrictions in order to inform about the provision of services and cooperation.

11.2 If the purchaser provides images of the product purchased from Garten-Q GmbH or if such images are created by the setup team of Garten-Q GmbH , Garten-Q GmbH is allowed to use these images on its website and social media sites without further consent of the purchaser, provided that persons or references to the specific location (e.g. street signs, location information) have been removed beforehand.

12. final provisions

12.1 Applicable law is the law of the Federal Republic of Germany. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence. The validity of the UN Convention on Contracts for the International Sale of Goods is excluded.

12.2 The exclusive place of jurisdiction for all disputes arising from this contract shall be the place of business of Garten-Q GmbH, insofar as the customer is a merchant, a legal entity under public law or a special fund under public law. If a customer as an entrepreneur has no general jurisdiction in Germany or if the residence or habitual abode of the entrepreneur at the time of the action is not known, the exclusive jurisdiction for all disputes arising from this contract is also the registered office of Garten-Q GmbH. The authority of Garten-Q GmbH to also call upon the court at another legal place of jurisdiction remains unaffected by this.

12.3 Severability Clause / Should any provision of these GTC be or become invalid or unenforceable, the remaining provisions of these GTC shall remain unaffected, unless the omission of individual clauses would put a contracting party at such an unreasonable disadvantage that it can no longer be expected to adhere to the contract.

 

Warranty and guarantee conditions Garten[Q] for all Garden-Q products with HPL doors from 1.10.2018

We are pleased that you have decided to purchase a Garten[Q] ! Please observe the following provisions and notes so that you can have a lot of fun with it.

I. General

  • When receiving the goods, check whether the delivery has visible damage. Otherwise, the shipping company will usually claim that any damage occurred after delivery. In case of obvious damage, refuse acceptance.

If there is only slight damage to the packaging on delivery, the goods can be accepted. In this case, however, the damage must be clearly described on the receipt and the same must be kept. Immediately take pictures of the damage and check the goods in the presence of the shipping company. Please coordinate with us the further procedure.

  • Until final assembly, store the kit in a dry place, not directly on the ground, protected from the weather (moisture, sunlight, etc.). Please do not store goods in a heated room!
  • It is important to read the assembly instructions completely before you start the assembly! This will help you avoid problems and unnecessary loss of time. You can find the latest version of the assembly instructions on the Internet at:

II. warranty conditions

The following terms and conditions shall apply to the exclusion of any general terms and conditions of the purchaser for all our deliveries and services. Deviating agreements require our express written confirmation and apply only to the specifically agreed case or cases.

1. duration and commencement of the warranty:

  • The warranty for products of Garten-Q GmbH is granted for a period of 10 years.
  • The period begins with the invoice date. Any replacement deliveries shall not result in an extension of the warranty period.

2. conditions for the guarantee:

  • The Garten-Q product was purchased directly from Garten-Q GmbH or from a Garten-Q sales partner. The original purchase receipt must be presented and the damage must be claimed against us in writing, by fax or by eMail immediately after it occurs and within the warranty period.
  • The assembly was done professionally according to the Garten-Q assembly instructions.
  • The garden Q product is used (depending on the model) to store garden tools, garden furniture, bicycles, garbage cans, etc..
  • The Garden Q product is owned by the original purchaser and has not been disassembled and reassembled.
  • Expeditious processing requires an orderly presentation of the damage in pictures and text and justification of the cause of the defect by the Garten-Q GmbH .

3. content and scope of the warranty:

  • The warranty covers parts which are demonstrably unusable or considerably impaired in their usability due to faulty design or defective workmanship. These parts will be repaired or newly delivered free of charge at the discretion of Garten-Q-GmbH.
  • Further claims and consequential damages are generally not covered by the warranty provisions. The costs for removal, installation and transport are not covered by Garten-Q GmbH . Replaced parts either become the property of Garten-Q GmbH or are to be disposed of by the customer.
  • The Garten-Q GmbH assumes no liability for any consequential damages.

4. limitations of the warranty:

  • This warranty does not cover defects which are due to:
    • Transport damage (the carrier is liable for this - please report immediately)
    • External influence or performance, extraordinary natural phenomena (e.g. hail).
    • General assembly errors (e.g. deviations from the assembly instructions)
    • Product incorrectly founded (foundations or similar), even with only minor defects, lack of water drainage in the soil profile area.
    • Unsuitable installation site and/or lack of anchoring (if the latter is required).
    • Damage to paintwork and scratches which have not been repaired immediately (applies only to painted parts).
    • Care errors (see care instructions)
    • Excessive ambient humidity or aggressive environmental substances (e.g.: proximity to the sea closer than 200 m).
    • Wear (e.g. cylinder lock, door hinge)
    • Oxidation of the screws. Some screws are unfortunately not available in stainless steel.
    • Damage caused by wind speeds above force 7, natural disasters or external (e.g. violent) impacts.
    • Exceeding common load limits (e.g. snow load more than 200kg/m²).
    • The product may have been modified in comparison to the assembly instructions.

A causal connection with the damage is generally not relevant. Only the statutory warranty period applies to rubber and plastic parts. Used products are excluded from the warranty.

  • This warranty shall expire if the customer is in default of payment or if the defect is not claimed and proven in writing immediately after the damage has been ascertained.
  • Please note the "Product deviations that do not constitute grounds for complaint" mentioned further below (see item "Warranty").

5. other:

The place of performance for all liabilities arising from warranty obligations is Munich, Germany.

III. warranty

Your Garten[Q] is made of high quality materials. If there are any complaints despite the careful checks, please contact us directly with your concerns.

Please note the following provisions:

  • Please be sure to keep your invoice for the purchase and submit it to us together with your claim! Without invoice you can not make any claims.
  • Own modifications at Garten[Q], no matter what kind, are excluded and lead to an expiration of the warranty claim.

Please note that product deviations do not constitute grounds for complaint:

  • Please note that the components are partly cut with lasers. Therefore, a burning smell can be normal when opening the packaging. In some cases, there may also be soot on the components, which must be wiped off.
  • Burns on the edges of the shelves are not grounds for complaint. The inlay shelves are deliberately cut with laser, as black edges visually match the overall product better than light edges.
  • Wood is a natural product, therefore the natural complaints do not belong under warranty.
  • Trespa is a natural product made of pressure-compressed wood fibers and resins. It has excellent properties in terms of weather resistance and durability. It can expand and contract slightly due to temperature differences. Therefore, "belly-ness" or warping of the doors may occur in some circumstances. This is not a defect and can often be avoided by readjusting the door hinges.
  • Material complaints will not be accepted if the product has been modified on your part (e.g. by painting own holes, etc.).
  • Branches that are firmly fused with the wood.
  • Wood discoloration without affecting the service life.
  • Cracks /dry cracks that are not continuous and do not affect the structure.
  • Natural expansion and contraction of the aluminum profiles
  • All aluminum components are made of raw aluminum. Simple irregularities and slight scratches can occur due to production and do not justify a complaint. Furthermore, the type of welding of the aluminum does not give any reason for complaint, unless this would not sufficiently connect parts or clearly disturb the typically visible area.
  • Natural weathering of the panel and wood materials
  • Later claims due to improper maintenance, installation, subsidence of the garden[Q]'s due to improper foundations and footings are excluded.

The following shall apply in general and to consumers: If the customer (hereinafter referred to as the "customer") does not notify us in writing of an obvious defect in our assembly kits (e.g. easily recognizable external damage/discoloration, missing parts, etc.) within a period of 6 days after delivery of the goods, he shall be deemed to have accepted this defect, unless a longer reasonable inspection period would have to be granted to the customer in accordance with the type of contract, the circumstances of delivery or the defect; in this case, the longer period shall replace the 6-day period. We shall not be liable for claims for damages under the warranty, unless we are responsible for the defect due to intent or gross negligence or/and if the damage has occurred to the life, body or health of a human being, within the scope of the statutory liability for fault.

The warranty period is one year, unless a case of § 438 para. 1 No. 2 or § 634a para. 1 No. 2 BGB is given. The statutory warranty limitation period shall apply if we sell a movable newly manufactured item to a consumer. Furthermore, the shortening shall not apply if we are accused of intent with regard to the warranty reason. The (repeated) rectification of defects shall only be unreasonable for the customer if more than two attempts to rectify defects fail in direct succession. If our CL is an entrepreneur, the following shall apply in addition: Subsequent performance shall in principle be effected at our discretion by remedying the defect (subsequent improvement) or by new delivery. If the legal requirements are met, the customer shall be entitled to withdraw from the contract or reduce the purchase price. His rights from §§ 478, 479 BGB remain unaffected.

For used items, the warranty is valid only for 12 months.

IV. Care

The Garten[Q] is basically made of high quality materials. In particular, the TRESPA doors are insensitive to moisture. The interior contains wooden panels that are also moisture-proof. However, in the event of permanent standing moisture, these wooden panels located in the interior can swell and warp. Therefore, please constantly ensure that the Garten[Q] is kept dry on the inside.

Possible formation of mold: Depending on the place of installation, fungal spores may be carried inside by wind. If they settle, mold may form. However, this is completely harmless and does not attack the Garten[Q] material. This mold should simply be wiped off with a damp cloth or removed completely with a brush.

Hinges must be oiled/greased regularly.

The Trespakern is basically black. On edges and milled areas (e.g. door strips) this core becomes visible. These areas turn gray over time, but this has no detrimental effect on the material properties. Depending on the color, this may even be more visually pleasing to customers. If you prefer black joints/edges, simply wipe them from time to time with cloth on which you have previously applied a little household oil. The Trespakern now appears again in a deep black.

V. Preparation and structure

NOTE: To avoid injury, please wear appropriate protective gloves during assembly and maintenance.

Set-up location

The installation site must be selected in such a way that sufficient ventilation is ensured on all sides.

When selecting a location, make sure that the Garten[Q] is not exposed to extreme weather conditions (areas with strong winds).

Foundation

An important point for the safety and durability of your Garten[Q] is a good foundation. Only a level and load-bearing foundation ensures proper assembly, stability and accuracy of fit of the doors.

Prepare the foundation so that the top edge protrudes at least 5 cm above the ground surface. This will ideally protect your Garten[Q] from moisture from below. Furthermore, the Garten[Q] is sufficiently ventilated.

We make the following foundation suggestions:

  • Concrete or sidewalk slab foundation (most recommended).
  • poured concrete foundation
  • Strip or point foundation (least recommended).

Prepare the foundation so that the four corners and - depending on the model - also the center of the Garten[Q] can be placed securely on it. The surface on which the points of the Garten[Q] resting on the floor must be permanently firm and absolutely level.

If necessary, seek the advice of a professional or have the foundation built by a professional.

Doors

Always remember to secure the doors so that they do not slam open and possibly break even in strong winds. The doors can be secured at the eyelets. A sturdy metal piece should be put through the eyelets at all times. E.g. carabiner, padlock or a thick wire.

The color of the striped design can be darkened by oiling the milled areas with a household oil.

If there is dirt on the doors, it can normally be simply wiped off with a damp cloth.

Roof construction

The roof or the Garten[Q] must never be lifted up by the aluminum edges. These would bend.

The roof is protected by a film that prevents the penetration of moisture. You must not place any sharp-edged objects on the roof. Damage to the roof foil must be avoided at all costs.

The roof cannot be walked on and must not be overloaded. Guideline value: 20 kg (without green roof module), 100 kg (with green roof module).

The roof edging has sharp edges and corners. Depending on the installation site, you must secure these with an appropriate corner or edge protector (from the DIY store).

Lime deposits can cause white edges and deposits to form on the foil and the metal parts. These can be easily removed with a damp cloth and some citric acid.

Floor construction

The floor or the Garten[Q] must never be lifted up by the aluminum edges of the floor construction. These would bend.
Heavy parts must not be pulled over the aluminum edges. Please also do not step on the aluminum edges.
The edges between the base plate and the aluminum frame should be grouted with silicone to permanently prevent moisture from penetrating.
The height-adjustable feet must lie flat. The Garten[Q] must be lifted completely to move. Do not push or pull.

Interior / Coated wooden panels

During heavy rainfall or when wet equipment is stored, water can form on the base plate and shelves. Due to the design of the Garden[Q], most of it will evaporate. However, larger amounts of water should be dried up with a cloth. Especially the unprotected wooden edges should not stand permanently in water.

I. General

We are pleased that you have chosen Garten[Q] !

It is important to read the assembly instructions completely before you start the assembly! This way you will avoid problems and unnecessary loss of time.

  • Until final assembly, store the kit in a dry place, not directly on the ground, protected from the weather (moisture, sunlight, etc.). Please do not store goods in a heated room!
  • When choosing the location, make sure that the Garten[Q] is not exposed to extreme weather conditions (areas with strong winds), if necessary, you should additionally anchor the Garten[Q] with the foundation.

II. warranty

Your Garten[Q] is made of high-quality spruce wood or OSB boards and is usually delivered untreated. If, despite our careful checks, complaints should arise, please contact us directly with your concerns.

Please note the following provisions:

  • Please be sure to keep your invoice for the purchase and submit it to us together with your claim! Without invoice you can not make any claims.
  • Own modifications at Garten[Q], no matter what kind, are excluded and lead to an expiration of the warranty claim.

Please note that deviations do not constitute grounds for complaint:

  • Wood is a natural product, therefore the natural complaints do not belong under warranty.
  • Material complaints are not accepted if a coating has already been applied! If you receive a painted delivery, this applies to self-paintings.
  • Branches that are firmly fused with the wood.
  • Wood discoloration without affecting the service life.
  • Cracks /dry cracks that are not continuous and do not affect the structure.
  • Twisting of the wood provided it can still be processed.
  • On the non-visible sides of roof and floor boards may be unplaned, there may be color differences and tree edges.
  • Later complaints due to improper care, assembly, subsidence of the garden[Q]'s due to improper foundations and foundations are excluded. Also for painted delivered Garten[Q]'s applies that the customer must check it and if necessary make a repair of insufficiently protected places in time.

The following shall apply in general and for consumers: If the customer does not notify us in writing of a defect in our wooden products and/or assembly sets which is obvious according to the type of goods (e.g. easily recognizable external damage/discoloration, missing parts, etc.) within a period of 6 days after delivery of the goods, he shall be deemed to have accepted this defect, unless a longer reasonable inspection period would have to be granted to the customer according to the type of contract, the delivery circumstances or the defect; in this case, the longer period shall take the place of the 6-day period. We shall not be liable for claims for damages under the warranty, unless we are responsible for the defect due to intent or gross negligence or/and if the damage has occurred to the life, body or health of a human being, within the scope of the statutory liability for fault.

 

The warranty period is one year, unless a case of § 438 para. 1 No. 2 or § 634a para. 1 No. 2 BGB is given. The statutory warranty limitation period shall apply if we sell a movable newly manufactured item to a consumer. Furthermore, the shortening shall not apply if we are accused of intent with regard to the warranty reason. The (repeated) rectification of defects shall only be unreasonable for the customer if more than two attempts to rectify defects fail in direct succession. If our CL is an entrepreneur, the following shall apply in addition: Subsequent performance shall in principle be effected at our discretion by remedying the defect (subsequent improvement) or by new delivery. If the legal requirements are met, the customer shall be entitled to withdraw from the contract or reduce the purchase price. His rights from §§ 478, 479 BGB remain unaffected.

There is generally no warranty for used items.

III. warranty conditions

We grant you under the following conditions - but only on our wooden products as far as they are made of wood, not on related components or parts of the Garten[Q]-product made of material other than wood - from the date of delivery 2 years warranty on function.

Within the warranty period, defective parts or missing parts of the goods or the goods themselves will be replaced free of charge at our discretion, i.e. you will receive the material from us at no additional cost. However, the costs arising from the replacement, in particular delivery and assembly or conversion costs and other consequential costs, are not included in the warranty claim. Warranty claims can only be made in connection with the original purchase receipt and must be submitted to us within the deadline in writing, by fax or by e-mail. The brisk treatment presupposes however an orderly representation of the damage in picture and text and reason of the lack causation by the Garten-Q GmbH ! Damages are basically excluded from the guarantee, if

  • the product may be incorrectly founded (foundations or similar), even with only minor defects,
  • may have deviated from the respective assembly instructions,
  • Wind speeds above force 7, natural disasters or violent impacts, may have occurred,
  • the load limits specified in each case (e.g. snow loads, etc.) may have been exceeded
  • any modification (additional attachments or conversions) may have been made to the product compared to the assembly instructions,
  • omitted or insufficient maintenance (maintenance: wood preservation, wood painting, etc.) of the wood may have been made,

A causal connection with the damage is generally not relevant. Changes in color, cracks, warping, shrinkage, swelling or similar normal changes due to the nature of the material "wood" and their consequences are expressly excluded from the warranty. Further claims and consequential damages are generally not covered by the warranty provisions. For components made of material other than wood, only the statutory warranty provisions and other laws apply; the warranty does not apply to these. Damaged or defective individual parts must be objected to before installation, otherwise the warranty claim will be voided.

There is generally no warranty for used items.

If necessary, the producer WEKA-Holzbau GmbH, Neubrandenburg, provides a warranty beyond this. At the time of the preparation of these provisions, this was 5 years. The warranty conditions of WEKA-Holzbau GmbH apply. We will be happy to help you with any questions you may have about the warranty.

IV. Painting and care

Wood is a natural product and works differently. Characteristics such as coarse and fine grains, color shades and changes as well as intergrowths have their origin in the growth of the tree. They are normal in woods that grow in the wild and therefore not to be regarded as a defect, but rather as a peculiarity of the natural material wood.

The untreated wood (except storage woods) will turn gray after some time, may turn blue and moldy. To protect your Garten[Q] , you should treat it with suitable wood preservatives.

In order to protect your garden house optimally, we recommend treating the floor boards with a colorless primer beforehand. Especially the bottom side, which is not accessible after assembly. Only in this way will prevent the penetration of moisture.

We strongly recommend to treat the doors with a primer as well. It is very important to paint both the inside and the outside of the doors at once! Otherwise they may warp.

After the construction we recommend you to prime the outer skin (without the roof), as soon as it is dry you should paint the house with a wood stain, which protects the wood from moisture and UV radiation.

When painting, use high-quality tools and paint, follow the paint manufacturer's safety and processing instructions. Never paint in full sun or rainy weather. Ask your dealer or a DIY store for detailed advice on wood preservation for untreated softwoods.

By painting regularly, you essentially affect the life of your Garten[Q]. We also recommend that you inspect the Garten[Q] every six months. - If you have received the Garten[Q] painted, an inspection and re-care or re-painting must take place no later than 6 months after assembly.

V. Preparation for the construction

NOTE: To avoid injury from possible wood splinters, please wear appropriate protective gloves during assembly and maintenance.

Foundation

A good foundation is important for the safety and durability of your Garten[Q] . Only an absolutely level and load-bearing foundation ensures proper assembly, stability and, above all, a perfect fit of the doors. With a good foundation, your Garten[Q] will last longer.

Prepare the foundation so that the top edge protrudes at least 5 cm above the ground surface, so that your Garten[Q] is better protected from moisture. Please also make sure that the Garten[Q] is sufficiently ventilated later on. We make the following foundation suggestions:

    • Concrete or sidewalk slab foundation
    • poured concrete foundation

Prepare the foundation so that the floor timbers are supported everywhere at a distance of max. 40 cm. All corner points of the Garten[Q] must be well supported.
